Midnight To Four Enterprises, doing business as AuctionRPM ("AuctionRPM," "we," "us," or "our"), respects the privacy of our website visitors, customers, and the individuals whose information may appear in customer-provided support databases. This Privacy Policy explains how we collect, use, disclose, retain, and protect information in connection with the AuctionRPM website at www.auctionrpm.com, software licensing, subscriptions, and support services.

This policy concerns information handled by AuctionRPM. Auction houses and other customers are responsible for their own collection and handling of information they enter into and manage with AuctionRPM software.

1. Information We Collect

Information you provide. When you contact us, request a trial, purchase or manage a subscription, or request support, we may collect your name, business name, email address, telephone number, mailing or billing information you provide, messages, and other information needed to respond to your request.

Licensing and subscription information. We may maintain customer identifiers, registration or activation codes, licensed user limits, selected plans, license type and status, subscription status, payment or transaction references, and related account history. We may retain records needed to recognize and support licenses purchased in prior years, including perpetual licenses.

Website and technical information. Our website, hosting systems, and licensing services may process IP addresses, browser or device information, request and error logs, security events, and cookie preferences. The information collected depends on the services and settings actually in use.

Support communications. We may keep correspondence, diagnostic information, and other materials you choose to provide in connection with a support request. Special rules for customer databases provided for troubleshooting are described in Section 4.

2. How We Collect Information

We collect information directly from you when you complete forms, contact us, request a trial, subscribe, or seek support; from our payment and service providers when they report relevant transaction or subscription information; and automatically through the technical systems needed to operate and secure our website and licensing services.

3. How We Use Information

We use information to:

• Respond to questions and provide customer service and technical support.
• Provide software downloads, trial registrations, registration codes, activation and license verification.
• Administer software subscriptions, optional support subscriptions, and existing perpetual-license records.
• Process and reconcile payments and communicate important transaction or service information.
• Diagnose software and service problems, maintain security, and prevent misuse or fraud.
• Improve our website, software, licensing systems, and support processes.
• Maintain business records and comply with applicable legal obligations.
• Send promotional communications where permitted, subject to applicable opt-out rights.

4. Customer Operational Data and Technical Support

Normal operation. AuctionRPM software is designed to allow customers to maintain their auction management data on their own computers and networks. During normal operation, customer operational data is not transmitted to AuctionRPM's servers. Such data may include bidder and buyer records, consignor information, inventory, auction transactions, payment and accounting information, and other customer business records. Licensing and registration communications are separate from this operational data.

Permission before transfer. Sometimes technical support personnel need a copy of a customer's database to reproduce and diagnose a software problem. Before transferring that database to AuctionRPM's offices or servers, our technical support personnel will request the customer's permission.

Permitted purposes. With that permission, customer databases provided for support may be used to investigate, reproduce, diagnose, and resolve software problems. We may also use retained copies for future software testing, troubleshooting, maintenance, and development related to AuctionRPM, and, when possible, to help a customer recover information lost through a computer failure or similar event.

Confidentiality. Customer operational data supplied for support is treated as confidential. We do not sell it, release it to the public, or use it for advertising or marketing. Access is limited to personnel and service providers with a legitimate need to perform the authorized technical functions, subject to appropriate confidentiality and security measures. Disclosure may nevertheless be required by applicable law.

Indefinite retention unless deletion is requested. We may retain customer databases received for technical support indefinitely for the purposes described above. If a customer specifically requests that its database be deleted after the relevant technical support issues have been resolved, we will honor that request, subject to any applicable legal preservation requirement. Requests may be sent to info@auctionrpm.com. We will take reasonable steps to identify and delete retained copies under our control, including copies in backups as they are removed or overwritten in the normal backup lifecycle where immediate deletion is not technically feasible. We will explain any legally required or technically unavoidable delay that affects a request.

Ownership and backups. The customer retains ownership and responsibility for its operational data. Providing a database for support does not transfer ownership to AuctionRPM. Although a retained database may occasionally assist with recovery, AuctionRPM does not provide or guarantee a backup or disaster-recovery service. Customers remain responsible for maintaining current, reliable backups of their own data.

5. Payments, Hosting, and Other Service Providers

Our website is operated using Squarespace. Subscription checkout and payment services are provided through Square. Payment information entered into a payment provider's checkout is handled by that provider; AuctionRPM generally receives payment confirmation, transaction identifiers, and subscription-related information rather than full payment-card numbers.

We may use additional vendors to provide website infrastructure, hosting, email delivery, security, and support. We share only information reasonably necessary for these services, subject to applicable agreements and legal requirements. We may also disclose information when required by law, to protect rights and security, or in connection with a legitimate business reorganization or transfer.

We do not sell personal information or customer databases. Depending on applicable privacy law, certain third-party analytics or advertising activities may be legally classified as "sharing" even when no money is exchanged; any such activity should be disclosed and controlled as required by law.

6. Cookies and Similar Technologies

Our website uses essential cookies or comparable technologies needed for functions such as security, site operation, and remembering privacy choices. Optional cookies or similar technologies may be used for analytics or other purposes where enabled.

Retention periods may differ by type of record.

9. Your Privacy Choices and Requests

You may contact us to request access to, correction of, or deletion of personal information we maintain about you. Depending on your location, applicable law may provide additional rights, including rights concerning certain uses or disclosures of personal information. We may need to verify your identity or authority before acting on a request, and some records may need to be retained for lawful business or legal reasons.

A customer's request to delete a database transferred for technical support is governed by the specific commitment in Section 4. It does not automatically require deletion of separate licensing, billing, or other records that we must or may lawfully retain.

You can also change optional cookie choices using the website's cookie-preference controls, and opt out of promotional email using any available unsubscribe instructions or by contacting us. Essential service or transaction notices may still be sent.

10. Third-Party Websites and Services

Our website may link to external websites, payment pages, or other services. Those services may have their own privacy notices and practices. We encourage you to review them when providing information directly to those services.

11. Children's Privacy

AuctionRPM is intended for business use and is not directed to children under 13. We do not knowingly solicit personal information from children under 13. If you believe a child has provided personal information to us, please contact us.
